1. Introduction

We, Aimtech Dynamics Private Limited ("we", "us", "our", "Company"), respect the privacy of everyone who visits this website, uses the F&Bos web application or uses our mobile applications (together, the "F&Bos Platforms"). This Privacy Notice and Policy ("Policy") explains how we collect, process, store and use your personal data when you use the F&Bos Platforms and the services provided through them ("Services").

This Policy forms part of our Terms of Service and is framed to comply with applicable Indian law, including the Digital Personal Data Protection Act, 2023 ("DPDP Act"), the Information Technology Act, 2000 and the rules made under them. By submitting your personal information to us and using the F&Bos Platforms, you consent to the collection, use and disclosure of that information as described in this Policy.

2. Personal information we collect

We limit collection to what is necessary to provide the Services, meet legal obligations or perform a contract. Depending on how you use the F&Bos Platforms, personal information may include: name and business name; email address; phone number; business address; billing and subscription details; GSTIN and tax-related identifiers; information you provide in surveys, reviews, support conversations or demo requests; and login credentials (stored in protected form).

On this website (fandbos.com): when you book a demo or request a guide, the details you provide (name, business name, city, phone number) reach us via WhatsApp or email and are used only to respond to you. This website takes no payments and stores no payment credentials.

In the F&Bos product: your account stores the business data you enter — menu, recipes, sales, inventory, staff records and customer records — solely to provide the Services.

3. Usage data, cookies and log information

We collect certain non-personal and technical information automatically: device type, IP address, browser type and language, operating system, date and time of requests, pages visited and interaction events. On fandbos.com we use Google Analytics 4 for aggregated measurement of how visitors use the site; this does not identify you personally to us. Cookies are used primarily for measurement and to improve the Services; you can block cookies in your browser without losing access to any content on this site. Mobile applications may collect app-usage and performance data to help us improve reliability.

4. Face Attendance: facial recognition and location data

The F&Bos Face Attendance feature processes two categories of data that deserve specific mention:

Facial data. When a staff member checks in, the camera on their device is used to verify their identity against their enrolled profile. Facial data is collected with the staff member's consent at enrolment, is used solely for attendance verification, is never used for advertising or profiling, and is never sold or shared with third parties except as required by law.

Location data. Check-in captures the device's location at the moment of check-in only, to confirm presence at the outlet. F&Bos does not continuously track staff location outside the check-in/check-out action.

The restaurant business (our customer) is the data fiduciary for its staff's attendance data and is responsible for informing staff and obtaining their consent; F&Bos processes this data on the customer's instructions as a data processor. Staff members may raise concerns about their attendance data with their employer or directly with us at the contact below.

5. How we use personal information

We use personal information to: provide, operate and support the Services; process subscriptions and billing; verify staff attendance where the customer enables Face Attendance; respond to enquiries and provide customer support; send service communications and, where you have opted in, product updates (you can opt out any time via the unsubscribe option or by writing to us); improve the Services, including through aggregated analytics; and comply with legal obligations, including tax and audit requirements.

6. Consent and withdrawal

Where our processing is based on your consent, you may withdraw it at any time by writing to sales@fandbos.com or WhatsApp +91 79803 72217. Withdrawal does not affect the lawfulness of processing carried out before withdrawal, and may mean some Services can no longer be provided. You will not suffer any detriment for withdrawing consent beyond the unavailability of those Services.

7. Your rights

Under the DPDP Act you have the right to: access a summary of the personal data we process about you; correct inaccurate or incomplete data; request erasure of data that is no longer necessary for the purpose for which it was collected; nominate an individual to exercise your rights in the event of death or incapacity; and a readily available grievance-redressal mechanism (Section 10 below). To exercise any of these rights, write to sales@fandbos.com or WhatsApp +91 79803 72217. We respond within the timelines prescribed under applicable law. If you remain unsatisfied after exhausting our grievance process, you may complain to the Data Protection Board of India.

8. Security and retention

We use appropriate physical, electronic and managerial safeguards to protect personal information — including encrypted transmission, hosted infrastructure with firewalls and access controls, role-based access within the product, and a full audit log of system actions. No method of transmission or storage is completely secure, and we cannot guarantee absolute security; please keep your username and password confidential, as instructions received under your credentials are treated as authorised by you.

We retain personal data only as long as necessary for the purposes in this Policy and to comply with legal requirements (for example, tax records). Upon cancellation of a subscription, business data remains exportable for a reasonable period, after which it is deleted or anonymised; anonymised data may be used for aggregate trend analysis.

9. Sharing with third parties

We do not sell personal data to anyone. We share elements of personal data only with service providers needed to run the F&Bos Platforms, under confidentiality obligations: hosting and cloud-infrastructure providers; analytics providers; payment processors (for subscription payments); and communication/support tools. Where the Services link to third-party websites or services, their privacy practices govern the information collected there — we encourage you to read their policies, as this Policy does not cover them. We may also disclose personal data in good faith where reasonably necessary to comply with law, legal process or an enforceable governmental request; to enforce our Terms; to detect or prevent fraud or security issues; or to protect rights, property or safety.

10. Grievance redressal

If you have any grievance regarding the F&Bos Platforms, the Services or your personal data, contact our Grievance Officer, who will acknowledge and work to resolve your concern within the timelines prescribed under applicable law:

11. Children

The F&Bos Platforms are business tools and are not directed at individuals under 18. We do not knowingly collect personal information from minors; if we become aware that we have done so inadvertently, we will delete it promptly.

12. Changes to this Policy

We may amend this Policy from time to time to reflect changes in law, our practices or the Services. Changes will be posted at this URL, and material changes will be notified through the product or by email. Continued use of the F&Bos Platforms after changes are posted constitutes acceptance of the revised Policy.

13. Governing law

This Policy is governed by the laws of India. Courts at Kolkata, West Bengal shall have exclusive jurisdiction over any matter arising out of this Policy.
